RESOLUTION #17-2021

IN THE MATTER OF establishing a records commission

WHEREAS: Refugee-Canyon Joint Fire District is an Ohio joint fire district established pursuant to Section 505.371 of the Ohio Revised Code; and

WHEREAS: R.C. 149.412 creates in each special taxing district that is a public office, for purposes of the Ohio Revised Code Chapter 149, a special taxing district records commission composed of the chair of the governing board of the special taxing district, a fiscal representative, and a legal representative of the governing board; and

WHEREAS: The Refugee-Canyon Joint Fire District is a special taxing district, for the purposes of Ohio Revised Code Chapter 149; and

WHEREAS: This Board finds it necessary to establish a local records commission and designate members pursuant to the requirements of R.C. 149.412;

 

NOW, THEREFORE, BE IT RESOLVED by the Refugee-Canyon Joint Fire District Board of Trustees:

SECTION 1. This Board hereby approves the establishment of a local records commission pursuant to R.C. 149.412 that shall be designated the Refugee-Canyon Joint Fire District Records Commission (“RCFD Records Commission”).

SECTION 2. Pursuant to the requirements of R.C. 149.412, this Board designates the Chair of this Board as a member and Chairperson of the RCFD Records Commission.

SECTION 3. Pursuant to the requirements of R.C. 149.412, this Board designates the Clerk/ Fiscal Officer of the Refugee-Canyon Joint Fire District as the fiscal representative of the RCFD Records Commission.

SECTION 4. Pursuant to the requirements of R.C. 149.412, this Board designates attorney Porter R. Welch, whose services were approved by Resolution #04-2021, as the legal representative of the RCFD Records Commission.

SECTION 5. This Board finds and determines it is necessary and proper for the fiscal representative of the RCFD Records Commission to prepare a record retention schedule for the approval of the RCFD Records Commission. Upon approval, the schedule shall be submitted to the Ohio History Connection.

BE IT FURTHER RESOLVED that it is hereby found and determined that all formal actions of this Board of Trustees concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and any of its committees that resulted in such formal action, were in a meeting open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
