RESOLUTION #06-2021

TO AUTHORIZE FIRE CHIEF TO CONDUCT PERSONNEL INVESTIGATION

WHEREAS: This date, March 11, 2021, Trustee Randy Wolf moved the adoption of the following Resolution:

WHEREAS: An allegation of misfeasance, malfeasance, nonfeasance, and/or misconduct in office by an employee of the Fire District in the performance of his official duty has been brought to the attention of the Fire Chief; and

WHEREAS: The position of the Fire District Board of Trustees is that allegations of misfeasance, malfeasance, nonfeasance, and/or misconduct in office by a District employee must be investigated; and

WHEREAS: Such investigations may warrant placing Fire District employee(s) on paid, administrative leave to protect the integrity of the investigation and protect the interests of the Fire District and its employees; and

WHEREAS: Such investigations may require the assistance of third parties to conduct the investigation; and

WHEREAS: Consistent with R.C. §505.38(A) the Board of Trustees must authorize the Fire Chief to conduct an investigation of personnel;

 

NOW, THEREFORE, BE IT RESOLVED by the Refugee-Canyon Joint Fire District Board of Trustees:

  1. Fire Chief Clifford L. Mason is hereby authorized to investigate of the allegation(s) of misfeasance, malfeasance, nonfeasance, and/or misconduct in office by an employee of the Fire District and prepare any necessary charges or recommendations to the Board of Trustees for discipline in conformity with R.C. §§733.35 to 733.39;
  2. Fire Chief Clifford L. Mason is hereby authorized to place the Fire District employee against whom allegation(s) of misfeasance, malfeasance, nonfeasance, and/or misconduct in office have been levied, on paid, administrative leave during the pendency of his investigation; and,
  3. Fire Chief Clifford L. Mason is authorized to engage the services of third parties to assist in his investigation.  Fire Chief Clifford L. Mason is authorized to expend up to $2,500.00 of District funds to engage the services of third parties to assist in his investigation.

Trustee Rich Moore seconded the Motion, and thereupon, the votes in favor of this Resolution were recorded and reflected by the signatures hereto.

BE IT FURTHER RESOLVED that it is hereby found and determined that all formal actions of this Board of Township Trustees concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and any of its committees that resulted in such formal action, were in a meeting open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
